World Rule of Law


Below are some of my thoughts on how rule of law might be established between the powers in the world. The biggest concern is to see that the system cannot be hijacked by some who would try to impose their will on the world. Would the checks and balances included below adequately address this concern? In the comments section at the bottom offer your suggestions. They will be folded in and this post will evolve.

What makes America work is as much rule of law as it is democracy. America, along with several other nations, has somehow managed the near impossible. It has established a rule of law system that preserves itself. When there have been attempts to skirt the laws or to make new laws that favor one person or group over another, again and again those attempts have been foiled.

Democracy for sure is part of this system - how many times have we voted out the cronies who were bending the laws to keep themselves in power or are trying to change the laws to favor their own beliefs and morals which were not those of the majority?

Why can't the we establish a similar system, a World Government (WG), for rule of law across the world? What might a set of World Laws look like?  Consider the below.

     ("one" = a sovereign state, an organization, a group of people, an individual, or the WG itself):
  1. one may not physically assault or abuse individuals
  2. one may not torture individuals
  3. one may not enslave individuals
  4. one may not imprison (or restrict movement of) people in such a manner that leads to inhumane conditions such as starvation, illness, death by exposure
  5. one may not impose significant environmental damage onto our lands/atmosphere/ecosystems 
  6. one may not imprison or physically restrain individuals except as is in accordance with very clear and justly applied state or WG laws
  7. one may not execute/kill individuals except when it is in accordance with very clear and justly applied state or WG laws
  8. when within the territory of a state one must abide by the laws of that state
  9. one may not interfere in the civil war of a state, unless civil war imposes significant harm upon other states, or unless the actions of the state experiencing the civil war grossly violate world laws 
  10. except when it is a world law enforcement action, one may not obstruct trade and travel between 2nd and 3rd party states, and may not conspire in this 
  11. except when it is a world law enforcement or justice action, outsiders may not undertake actions to harm a state or its government
  12. one may not bribe or pay graft to state officials or representatives
  13. one may not obstruct justice concerning world laws
  14. one may not conspire with others toward violating a world law 
  15. one may not harbor or assist individuals or groups who are violating a world law

Democracy Structure to put the World Government under the Control of the People:
  1. A World Executive Branch like in the US.  Elected president, term limits of <8 years total;
  2. A World Congress like in the US. Elected representatives.  A senate consisting of 2 senators from every nation.  A House with the number of representatives based on nations' populations. Term limits of <8 years total, all elected by the populations of their nations;
  3. One big difference from the US congress:  neither branch of congress would be led by a political party.  Instead the speaker of the house and the leader of the senate would be elected (from congress members) by the people, and would be sworn to behave in a non-partisan manner - simply be leaders of their branches of congress.  Elections for new congressional leaders would be run whenever the public expressed "no confidence" in current leaders. No campaigning for the leadership positions would be allowed.   
  4. A World justice system - judges appointed by the president, life terms - except any judge can be voted out via majority vote by the public;
  5. Government revenue - exclusively from donations by anonymous benefactors;
  6. Elections - all done via the Internet, every person in the world has a vote, system/verification/enforcement of polling via peer network systems run by volunteers.

World Government Mission
  1. Protect individuals from abuse, inhumane treatment and suffering
  2. Maximize cooperation and minimize conflict between the nations and other powers of the world
  3. Protect the world environment and ecosystem

World Government Power and Authority:
  • (A) establish and evolve world laws; 
  • (B) exercise police and military action to enforce world laws; 
  • (C) run a world court system to determine guilt/innocence and to exact sentencing; 
  • (D) take action, as specified by the courts, against world law violators

Restrictions on the World Government:
  • (A) all WG officials and employees, and anyone or any organization acting on behalf of the WG are subject to the same world laws and the same treatment under the laws as anyone else; 
  • (B) the WG has to operate as a non-profit organization - it may not show a year-to-year profit; 
  • (C) the WG may not take on debt; 
  • (D) the WG may not own or operate for-profit organizations; 
  • (E) the total wealth holdings of the WG may not exceed 1% of total world wealth; 
  • (F) the WG cannot issue or control a currency; 
  • (G) the WG organization itself, all WG officials and employees, and anyone or any organization acting on behalf of the WG may not accept money, property, gifts or favors in return for their actions or inactions in their WG duties and responsibilities; 
  • (H) the WG must be open with information regarding its operations - there is no "Top Secret" information, there is no information that may be classified as a threat to WG security; 
  • (I) the WG may not take military action pro-actively; 
  • (J) WG military and law enforcement actions must be conducted only by individuals with allegiances only to the WG; 
  • (K) all elected WG officials must have allegiances only to the WG; 
  • (L) the WG may not levy taxes or fines; 
  • (M) WG elected officials may not receive payment for their services.  They may though receive from the WG food, shelter and transportation for themselves and for their immediate families at levels that are fair and reasonable.   All compensation recieved by WG officials from the WG must be documented and this information must be readily available to the public.
  • (N) campaign funding for candidates running for WG positions must come entirely from donations by individuals, and who donates what to whom must be fully documented and available for all to see.

Intended nature of the World Government resulting from its structure and power balances as laid out above:
  • If the WG is doing nothing worthwhile then its benefactors will quit giving donations, its revenues will drop and it will fade away
  • If the WG is violating its restrictions (listed above), the people who fund it via their donations will be able to correct this by reducting their donations
  • Because the sources of WG revenue would be anonymous, conflicts of interest would be minimized
  • Its term limits and its election processes would protect the WG from those that might try to dominate or to take control it away from the people
